Law360 (December 15, 2020, 4:55 PM EST) — U.S. Rep. Joaquin Castro, D-Texas, proposed massive changes to the H-2B visa program on Tuesday in an AFL-CIO backed bill calling for a pathway to citizenship for H-2B workers, a revised visa allocation system and a ban on employers who abuse the program.
Castro explained that the Seasonal Worker Solidarity Act would create a “new framework” for the H-2B program — which allows seasonal workers to work in non-agricultural positions for brief stints — intended to prevent discrimination and the displacement of migrant and U.S. workers, and reward employers who treat workers properly.
